Conditions of Participation in the Cheese Auction
1. Purpose
This document sets out the terms and conditions governing the participation of users in the auctions organised through our web platform dedicated to the auction of cheeses from the Idiazabal Cheese Contest of Ordizia (hereinafter, “the Platform”). Participation in the auctions implies full and unreserved acceptance of all the provisions contained in this document.
2. Requirements for Participation
Only natural persons over 18 years of age or duly incorporated legal entities may take part in the auctions, provided that they register on the Platform and supply all the requested details truthfully and in full.
3. Registration on the Platform
The user must register on the Platform by completing the registration form, in which they will be required to provide certain personal details and a credit card. The user undertakes to keep those details up to date and to report any change. Access to the Platform and participation in the auctions are conditional upon correct registration.
4. Operation of the Auction
The auctions will be held virtually and in person, in real time. On the one hand, those present at the Idiazabal Cheese Contest of Ordizia event and, on the other, those attending the video conference convened for that purpose. They will have a specific duration and specific conditions, which will be established for each particular case and will be available for consultation before the auction begins. Users may place bids on the products being auctioned for as long as the auction lasts, either in person or virtually through the video conference chat. The highest bid at the close of the auction will be deemed the winning bid, and the bidder will be obliged to purchase the product. If the winner is a virtual participant, 10% of the amount of the winning cheese will be charged to their credit card immediately.
5. Obligations of the User
When taking part in an auction, the user undertakes to:
- Comply with all the conditions set out in this document and in the specific conditions of each auction.
- Place only bids that they are willing and able to honour.
- Pay the final award price of the auctioned product, plus any additional costs that may apply, within the period and in the manner established.
6. Prohibitions
The following is expressly prohibited:
- Manipulating the conduct of the auction by means of fraudulent behaviour.
- Placing bids on behalf of third parties without their express consent.
- Using false identities or impersonating other users.
7. Completion of the Purchase
Once the auction has ended, the winning user will receive a notification through the Platform, with the details for proceeding to pay the remainder by bank transfer (excluding the 10% paid by credit card) and to receive the product. The purchase will be deemed completed once payment has been confirmed by the user.
8. Rights of the Organiser
The Platform reserves the right to cancel or modify the auctions, as well as to suspend a user’s account temporarily or permanently in the event of a breach of these conditions.
9. Liability
The Platform will not be liable for any damage or loss that may arise from improper use of it, nor for any incidents that may occur during the course of the auctions.
10. Amendment of the Conditions
The Platform reserves the right to modify these conditions at any time, giving users sufficient advance notice so that they can decide whether they wish to continue taking part in the auctions.
11. Governing Law and Jurisdiction
These conditions shall be governed by and construed in accordance with Spanish law. For the resolution of any dispute that may arise from participation in the auctions, the parties submit to the Courts and Tribunals of the city of Tolosa.
